Bu İstifadə Şərtləri ("Şərtlər") Vivon tətbiqinin ("Vivon", "biz", "tətbiq") istifadəsini tənzimləyir. Tətbiqi yükləyərək və ya istifadə edərək bu Şərtləri qəbul etmiş olursunuz. Bu Şərtləri qəbul etmirsinizsə, tətbiqi istifadə etməyin.

1. Yaş tələbi

Vivon yalnız 18 yaşından yuxarı istifadəçilər üçün nəzərdə tutulmuşdur. Qeydiyyatdan keçərək 18 yaşınızın tamam olduğunu təsdiq etmiş olursunuz. 18 yaşdan kiçik olduğunuz aşkar edilərsə hesabınız dərhal silinəcək.

2. Hesab qeydiyyatı

Doğru və aktual məlumatlar təqdim etməlisiniz;
Hesab təhlükəsizliyinizi qorumaq sizin məsuliyyətinizdədir;
Bir şəxsə bir hesab icazə verilir;
Hesabınızı üçüncü şəxslərlə paylaşa bilməzsiniz.

3. İcazə verilməyən davranışlar

Aşağıdakı hərəkətlər qəti qadağandır:

Çılpaqlıq, cinsi məzmun, cinsi təklif və ya cinsi xidmət tələbi;
Yetkinlik yaşına çatmayan şəxslərin göstərilməsi və ya onlar haqqında məzmun;
Zorakılıq, təhdid, təhqir, nifrət nitqi, təzyiq və ya qorxutma;
Başqa şəxsin adından çıxış etmək və ya saxta profil yaratmaq;
Spam, reklam, kommersiya təklifləri, saxtakarlıq və ya fişinq;
Zərərli proqram, virus və ya kod yayılması;
Digər istifadəçinin şəxsi məlumatlarını icazəsiz toplamaq və ya paylaşmaq;
Zəng və ya söhbətlərin icazəsiz yazılması, ekran görüntüsü çəkilməsi;
Tətbiqin təhlükəsizlik mexanizmlərini yan keçməyə çalışmaq.

Bu qaydaların pozulması xəbərdarlıq, müvəqqəti dayandırma və ya hesabın daimi silinməsi ilə nəticələnə bilər.

4. İstifadəçi məzmunu

Tətbiqə yüklədiyiniz və ya göndərdiyiniz məzmunun (foto, mesaj, profil məlumatı) sahibisiniz. Bununla belə, xidmətin işləməsi üçün Vivon-a həmin məzmunu göstərmək, ötürmək və emal etmək üçün icazə verirsiniz. Şikayət edilən və qaydaları pozan məzmunu xəbərdarlıq olmadan silə bilərik.

5. Vivon Gems (virtual valyuta) və ödənişlər

Gems tətbiq daxilində video zənglər üçün istifadə olunan virtual valyutadır;
Gems paketləri Google Play, App Store və ya digər ödəniş provayderləri vasitəsilə satın alına bilər;
Gems geri qaytarılmır, nağdlaşdırılmır və başqa hesaba köçürülmür (məcburi qanuni tələb olduqda istisna);
Gems balansı hesabınızla bağlıdır və hesab silinərsə itir;
Qiymətlər əvvəldən xəbərdarlıq etmədən dəyişə bilər;
Abunə formatında satış varsa, ləğv etmə ödəniş provayderinizin (Google Play / App Store) hesabı üzərindən edilir.

6. Zəng haqqı

Video və səs zəngləri hər saniyə üçün müəyyən edilmiş miqdarda Gems tutur. Balansınız bitdikdə zəng avtomatik sonlanır. Cari tariflər tətbiq daxilində göstərilir.

7. Üçüncü tərəf xidmətləri

Vivon Google Sign-In, Apple Sign In, WebRTC infrastrukturu və bulud xidmətlərindən istifadə edir. Bu provayderlərin öz şərtləri və məxfilik siyasətləri tətbiq olunur.

8. İntellektual mülkiyyət

Vivon markası, loqotipi, tətbiq dizaynı və kodu Vivon-a məxsusdur. İcazəsiz surətini çıxarmaq, dəyişdirmək və ya yaymaq qadağandır.

9. Hesabın ləğvi

Hesabınızı istənilən vaxt tətbiq daxilindən silə bilərsiniz. Silinmə tələbindən sonra 30 gün ərzində daxil olsanız silmə ləğv edilir; əks halda hesab və bütün əlaqəli məlumatlar (mesajlar, fotolar, Gems balansı) daimi olaraq silinir. Biz də Şərtlərin pozulması halında hesabınızı xəbərdarlıqla və ya xəbərdarlıqsız dayandıra və ya silə bilərik.

10. Zəmanət imtinası

Vivon "olduğu kimi" təqdim olunur. Xidmətin fasiləsiz, xətasız və ya konkret gözləntilərinizə uyğun olacağına dair heç bir zəmanət vermirik. Digər istifadəçilərin davranışına və göndərdiyi məzmuna görə məsuliyyət daşımırıq.

11. Məsuliyyət məhdudiyyəti

Qanunun icazə verdiyi maksimum həddə, Vivon dolayı, təsadüfi və ya nəticəvi zərərlər üçün məsuliyyət daşımır. Vivon-un ümumi məsuliyyəti son 6 ay ərzində bizə ödədiyiniz məbləği aşa bilməz.

12. Dəyişikliklər

Bu Şərtləri zaman-zaman yeniləyə bilərik. Yenilənmiş versiya bu səhifədə dərc olunduğu andan qüvvəyə minir. Əhəmiyyətli dəyişiklikləri sizə bildirməyə çalışacağıq.

13. Tətbiq olunan qanun

Bu Şərtlərlə bağlı istənilən mübahisə Azərbaycan Respublikasının qanunlarına uyğun həll edilir.

These Terms of Service ("Terms") govern your use of the Vivon app ("Vivon", "we", "the app"). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. Age Requirement

Vivon is intended only for users aged 18 and older. By registering, you confirm that you are at least 18 years of age. If we find you are under 18, your account will be deleted immediately.

2. Account Registration

You must provide accurate and current information;
You are responsible for keeping your account secure;
Only one account per person is allowed;
You may not share your account with third parties.

3. Prohibited Conduct

The following are strictly prohibited:

Nudity, sexual content, sexual solicitation, or requesting sexual services;
Showing minors or content about minors;
Violence, threats, harassment, hate speech, pressure, or intimidation;
Impersonation of another person or creating fake profiles;
Spam, advertising, commercial solicitation, fraud, or phishing;
Distributing malware, viruses, or malicious code;
Collecting or sharing another user's personal information without consent;
Unauthorized recording or screenshotting of calls or conversations;
Attempts to bypass the app's safety mechanisms.

Violation of these rules may result in warnings, temporary suspension, or permanent account deletion.

4. User Content

You own the content (photos, messages, profile information) you upload or send to the app. However, to operate the service, you grant Vivon permission to display, transmit, and process that content. We may remove reported or rule-violating content without prior notice.

5. Vivon Gems (Virtual Currency) and Payments

Gems are the in-app virtual currency used to pay for video calls;
Gems packages can be purchased through Google Play, App Store, or other payment providers;
Gems are non-refundable, cannot be cashed out, and are not transferable between accounts (except where required by law);
The Gems balance is tied to your account and is lost if the account is deleted;
Prices may change without prior notice;
If offered as a subscription, cancellation is done through your payment provider's account (Google Play / App Store).

6. Call Rates

Video and voice calls consume a set amount of Gems per second. Calls end automatically when your balance runs out. Current rates are shown inside the app.

7. Third-Party Services

Vivon uses Google Sign-In, Apple Sign In, WebRTC infrastructure, and cloud services. These providers' own terms and privacy policies apply.

8. Intellectual Property

The Vivon brand, logo, app design, and code belong to Vivon. Unauthorized copying, modification, or distribution is prohibited.

9. Account Termination

You may delete your account at any time from within the app. If you sign in again within 30 days after requesting deletion, the deletion is cancelled; otherwise the account and all related data (messages, photos, Gems balance) are permanently deleted. We may also suspend or delete your account with or without notice if these Terms are violated.

10. Disclaimer of Warranties

Vivon is provided "as is". We do not warrant that the service will be uninterrupted, error-free, or meet your specific expectations. We are not responsible for other users' behaviour or the content they send.

11. Limitation of Liability

To the maximum extent permitted by law, Vivon is not liable for indirect, incidental, or consequential damages. Vivon's total liability shall not exceed the amount you paid us in the last 6 months.

12. Changes

We may update these Terms from time to time. The updated version takes effect when posted on this page. We will try to notify you of material changes.

13. Governing Law

Any dispute related to these Terms is governed by the laws of the Republic of Azerbaijan.
